Terms of Service

1. Acceptance of Terms

By accessing or using TailorMarket.ae ("the Platform"), a brand of Stitch Capital L.L.C-FZ (Licence Number 2535940.01), registered in the Meydan Free Zone, Dubai, United Arab Emirates ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Platform.

These Terms are governed by UAE Federal Laws and the applicable laws of the Emirate of Dubai.

2. Beta Program

TailorMarket is currently in a closed beta testing phase. By using the Platform during the beta period, you acknowledge and agree that:

• The Platform may contain bugs, errors, or incomplete features.
• Service availability is not guaranteed and downtime may occur without prior notice.
• Data collected during beta may be deleted or reset when transitioning to the production environment.
• Features, pricing models, and commission structures are subject to change.
• We may limit or revoke access to the beta at our sole discretion.
• Your feedback and suggestions may be used to improve the Platform without compensation.

3. Eligibility

To use TailorMarket, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into binding contracts under UAE law.
• Provide accurate and complete registration information.
• If registering as a Tailor: hold a valid business license issued by a UAE authority.

4. User Accounts

4.1 Account Types

• Customer: Individuals seeking tailoring services.
• Tailor: Licensed tailoring professionals offering services through the Platform.

4.2 Account Responsibilities

• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately of any unauthorized access to your account.
• You may not create multiple accounts or share your account with others.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Platform Services

TailorMarket is an online marketplace that connects customers with professional tailors. We provide the technology platform and facilitate transactions. We are not a party to the service agreement between customers and tailors.

5.1 For Customers

• You may browse tailor profiles, request services, and place orders.
• You may submit bidding requests to receive competitive quotes from tailors.
• You are responsible for providing accurate measurements and order specifications.
• You must inspect and confirm delivery of completed orders in a timely manner.

5.2 For Tailors

• You must hold and maintain a valid UAE business license throughout your use of the Platform.
• You must complete a verification process before becoming visible in the marketplace.
• You are responsible for the quality and timely delivery of your services.
• You must honor accepted orders and quoted prices.
• You may manage team members (employees) under your tailor profile.

6. Orders & Transactions

6.1 Order Process

• Orders may be placed as Direct Orders (to a specific tailor) or Bidding Orders (open marketplace).
• An order is binding once a tailor accepts it and the customer completes payment.
• Urgency surcharges (Priority, Rush, Emergency) apply as displayed at checkout.

6.2 Cancellations

• Customers may cancel orders that are in Pending, Accepted, or Awaiting Payment status.
• Orders that are In Progress, Ready, or Delivered cannot be cancelled directly and must go through the dispute process.
• Repeated cancellations may affect your account standing.

7. Payments

• All payments are processed through Stripe, our third-party payment provider.
• Payments are held in escrow until the order is confirmed as delivered.
• Upon confirmed delivery, the payment is released to the tailor after deducting the platform commission.
• All prices are displayed in AED (UAE Dirham) unless otherwise stated.
• Refunds for disputed orders are handled on a case-by-case basis as outlined in Section 8.

Beta note: During the beta phase, payment processing may use Stripe's test mode. Real transactions may not be processed until public launch.

8. Disputes & Refunds

• Customers may open a dispute for quality issues, wrong items, items not as described, or damaged items.
• Disputes are reviewed by our team and may be resolved in favor of the customer, the tailor, or as a partial refund.
• Evidence (photos, messages) may be required to support a dispute claim.
• Our dispute resolution decision is final during the beta phase, without prejudice to your legal rights under UAE law.

9. Tailor Verification & Tiers

• Tailors must submit a valid business license for verification.
• Verification is reviewed by our team and may be approved or rejected.
• Tailor tiers (New, Verified, Expert, Master) are calculated based on order volume, revenue, and cancellation rate over a rolling 90-day period.
• Achievements and badges are awarded automatically based on performance milestones.
• We reserve the right to revoke verification if a tailor's license expires or conduct violates these Terms.

10. Prohibited Conduct

You agree not to:

• Provide false or misleading information.
• Circumvent the Platform to arrange transactions directly with the intent of avoiding platform fees.
• Engage in fraudulent activity, including fake reviews or orders.
• Upload harmful content, malware, or illegal material.
• Harass, threaten, or abuse other users.
• Violate any applicable UAE law or regulation.
• Scrape, mine, or extract data from the Platform without authorization.
• Attempt to gain unauthorized access to other accounts or platform systems.

11. Intellectual Property

• The TailorMarket name, logo, and platform design are our intellectual property.
• Content you upload (portfolio images, reviews) remains your property, but you grant us a non-exclusive license to display it on the Platform.
• You may not reproduce or distribute Platform content without our written consent.

12. AI-Powered Features

TailorMarket uses AI (Google Gemini) for style recommendations and assistance. You acknowledge that:

• AI-generated recommendations are suggestions only and not professional advice.
• We do not guarantee the accuracy of AI-generated content.
• Limited order and preference data may be processed by AI service providers to generate recommendations.

13. Limitation of Liability

To the maximum extent permitted by UAE law:

• TailorMarket acts solely as an intermediary platform. We are not responsible for the quality, safety, or legality of tailoring services provided by tailors.
• We are not liable for disputes between customers and tailors beyond our dispute resolution process.
• During the beta phase, the Platform is provided "as is" and "as available" without warranties of any kind.
• Our total liability shall not exceed the amount of fees you have paid to us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless TailorMarket, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

15. Termination

• You may deactivate your account at any time by contacting us at info@tailormarket.ae.
• We may suspend or terminate your account for violation of these Terms, at our sole discretion.
• Upon termination, your right to use the Platform ceases immediately.
• Provisions relating to intellectual property, limitation of liability, and governing law survive termination.

16. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with the UAE Personal Data Protection Law (PDPL).

17. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated at least 14 days before taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

18. Governing Law & Jurisdiction

These Terms are governed by the laws of the United Arab Emirates and the applicable laws of the Emirate of Dubai. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
